At least Alito and Thomas voted to hear the case, even if it was filed less than perfectly.
That's what I'm thinking. Scotus said TX could still file as is but TX wouldn't get result they're looking for, so maybe changing wording and intent would
Not saying it's for sure but I do know that wording is important when filing motions. Scotus did say that TX could continue filing but they were just stating upfront that if it continues as is they wouldn't like the results. This may not be the way but I'm all for going about this every which way until we get an outcome that we like
