From what I gathered from lawyer pede, there's no injury until the defendant states have presented their electors to the federal government on a fraudulent basis. Ie nobody's been hurt yet. Presumably the lawsuit can be re-filed or become relevant again once the states put forward their fake electors.
The Texas lawsuit wasn't alleging fraud dum dum. It said the states changed their election laws without the legislature which violated the constitution.
