What could happen is the senate and house disagree and the tie breaker is Pence. States could send electors for both candidates, and Pence could vote for Trump's. Also, if nobody is picked because it's contested it doesn't go to Pelosi it goes to state delegations where each state gets one vote and Trump wins.
There's also the whole insurrection act and DNI report option, which is ugly but still exists depending on the results of the report. Which is why I said wait for the sixth OR Trump to say something. It's also interesting that they refused this case now but the other case is still open (unless something happened this morning I'm going to go check news after I post this haha). They only refused to grant relief before hearing the other case, they didn't refuse to hear it. And there are multiple other cases in line too.
Nobody knew about this TX case a few days ago and we all thought we'd win anyway, it being denied ends nothing. Though it is interesting that all three of trump's judges said no, maybe there's a reason we aren't aware of yet.
