It seems to me that if the took it a ruled for Texas/ They would pretty much would have had to if they wanted to say the constitution mattered.
There's only one strong reason I can thing of that they don't, self interest. They'd have to deal with being blamed for when upset Democrats riot and burn their cites. Which is a big nod to how they would rule. Trump's supportes never reacted in such a way and would not if they did rule against him. They'd be pissed, angry and resist; but not loot, kill, and burn senselessly.

No, Biden not being elected yet (different from inaugurated) meant that texas was suing for harm that would be done. Since the election isn't 'official' the manner in which they ran their election has no bearing on Texas.
