There are many EO’s written by presidents throughout history that were never activated. Again im not saying that it cant happen just that its unlikely. Much more likely however than Joe Biden getting 81 million votes

The fact the EO even exists under what we now see was almost exact cicrumstances proves it's intention for use.

I somewhat agree with the OP. I've always believed military arrests were inevitable. Even if SCOTUS heard the case and ruled in favor of Texas... the criminals and traitors would still need to be criminally punished.

I think a SCOTUS win would have been great for optics but ultimately wouldn't effect the final act.
