Before the Texas case, there wasn’t a clear signal from SCOTUS that they have no interest in upholding the US Constitution.
Better to know what pieces are in play and can rely on earlier in the game, rather than later.
Just pointing out that before the Texas case was filed there was "multiple pathways to victory"
