Like all rules, they have to define 'props'. In the common dictionary definition of prop, a flag over the shoulder might be a costume when used as a shawl, or a prop, if used as a tarp. Leftists love making ambiguous rules, then their 'authority' to control you. If people just agree to very very clear rules, we could get along better.

The US flag should never be worn or considered to be someone’s shawl.

Why not just take it as a background. Seems like a decent loophole since it would not be an addition to the photo.
