Yes, think about it. SCOTUS could not have done anything even if they had hear the case. The Constitution says that the state legislatures are the ones who pick the electors, so if SCOTUS ruled the election tainted, their only Constitional remedy would be to tell the state legislatures, hey don't trust your popular vote tallies when you pick your electors but you still have the right to pick whoever you want.

The "brawl in congress on the 6th" scenario was always the most likely one. People got their hopes up in the Texas suit because the Supreme Court could have tied this all up in a neat bow and saved us all a lot of headaches and risk.

Enough info has to come out to get the state legislatures over the line, though, and our Chi-crats will fight that every step of the way.

Then no candidate gets to 270. And contingent election, Congress, one vote per state.

You're right though, we don't have Congress, so we couldn't reject electoral votes outright.

Doesn't Pence also have the power to choose whichever slate of electors he wants if two are submitted? Which means Trump could get to 270 right then. And the Supreme Court is making it pretty clear that they want to stay out of this, so I don't think there is much anyone could do about it.

That's the correct form of the "brawl on the 6th" scenario. It requires state legislatures to submit their own slate of electors so that there are two options.

A bunch of them seem to still be struggling to read this you-ess cone-stay-two-shone thing that kids are on about these days (it's the first they've heard of it, you see). But they've got until the 5th to get someone to explain it to them in small words.

The only situation where there would be a single slate that gets decertified is if the ODNI report is such a blockbuster that the nation as a whole is ready to revolt otherwise, and that would require pretty miraculous levels of evidence. And at that point the state legislatures would surely have acted.

This theory is a bit "Bernie can still win", except for the fact that everyone on both sides is sure as hell acting like this isn't over. And since it's not over, the question remains why Trump thinks he can win and everyone is acting like he's right. The 6th is the most obvious mechanism remaining for this to happen.

There are huuuuuge differences between Bernie and Trump. Bernie was/is a powerless shill working for the DNC. He wasn't ever supposed to win. Here is the process to challenge a state's electors during the January 6, 2021 Joint Session of Congress where the electoral votes are officially counted:

  • One Representative and one Senator must submit a written objection to the President of the Senate (VP Pence).

  • The Joint Session then breaks up and the objection is debated separately by the House and Senate in their respective chambers.

  • The House and Senate each vote on the objection. The objection is sustained or rejected by a majority vote.

  • Both the House and Senate must vote to sustain the objection or the state's electors are counted.

  • If a state's electors are rejected, most believe that state's electoral votes are to be subtracted from the total of 538 and the winner is the candidate with a majority of the remaining number. For example, if PA's 20 electors are rejected, 260 which is the majority of 518 (538-20) becomes the winning number. Under this interpretation of the rules, the only situation where the House would choose the President and the Senate would choose the VP is a tie electoral vote.

To date, other than maybe Nevada, which is only 6 EC votes, there is no evidence that any of the other states are going to send their electors. In fact MI and PA said they CAN'T because the power was delegated to the SOS.

It's my understanding that the Electoral Count Act wouldn't give this level of discretionary authority to the VP.

It does give an opportunity for congress to dispute though.
