Charles Murray (the Bell Curve guy) wrote an entire book on that kind of thing, called By The People: Rebuilding Liberty Without Permission. Not sure if there are any think tanks or legal groups adopting his tactics yet, but reading about it might give you some ideas.

I am not an attorney, but I've walked through loads of lawsuits, contract negotiations, and large asset sales, so I have some grasp of how things work.
It's time to start thinking creatively in order to defend ourselves.
