Yea he's awesome and one of the best IMHO. Yesterday and this morning he was smoking out the CCP like crazy. Legally, no, not as a defense. Kind of the same in Georgia when video clearly showed the inner, signed envelopes going to the shredder.

To answer your question from a legal standpoint the defendants in Trump lawsuits cannot use lost data as a defense, they must retain the records by law. However it can be used by Trump's team as spoliation of evidence thus guilty by negative inference; this is similar to being charged with accounting fraud and wiping the company hard drive "like with a cloth or something". No can do.

I am not an attorney but a scientist, so I know a bit about evidence from a technical standpoint.

If they catch you at the sink furiously scrubbing a knife infront of a dead body it is circumstantial evidence.

Better to catch midstabbing, but if they cannot explain their actions then they will likely be found guilty.

It's even worse than that, because an election is a planned event with certain strict protocols (not as strict as they should be evidently). They are required by law to keep these records. So not having the records is evidence of wrongdoing on its own.

If there are no ballots there was no election. Thats their case. Machines dont matter. Hand count every vote. In GA. If there is no signature to exsmine, then the election is voided and sent to electors.

Adjudicated ballots could be dragged and dropped to a candidate. Any poll worker could do this.
