Trump is the President, the Chief Executive and therefore Chief Law Enforcement Officer... the DOJ only has executive authority because the President gives it to them. They can do nothing the President could not otherwise do himself. Therefore, can’t he unilaterally run the DOJ, such as appoint a special counsel or sue a State?

He already can do both of those things. However the DOJ is supposed to be apolitical. So its kind of unethical for a President to step in.

He is already very much in the middle of suing multiple states.
