I don't know, but it takes 67 senators to overturn an executive order. It's possible the Deep State simply didn't have the necessary majority to shut him down. Most votes are "whipped" for days or weeks before being brought to the floor. If the Whip can't get the pledges he needs for votes, he knows it's mostly pointless to call the vote. The only purpose it would serve is to go "Look who voted for\against this!"

He didn't overturn it, he blocked it with an injunction, which is temporary and contingent on his winning a case at a later time. Or am I mistaken?
