(1) No vaccine manufacturer shall be liable in a civil action for damages arising from a vaccine-related injury or death associated with the administration of a vaccine after October 1, 1988, if the injury or death resulted from side effects that were unavoidable even though the vaccine was properly prepared and was accompanied by proper directions and warnings.

(2) For purposes of paragraph (1), a vaccine shall be presumed to be accompanied by proper directions and warnings if the vaccine manufacturer shows that it complied in all material respects with all requirements under the Federal Food, Drug, and Cosmetic Act [21 U.S.C. 301 et seq.] and section 262 of this title (including regulations issued under such provisions) applicable to the vaccine and related to vaccine-related injury or death for which the civil action was brought unless the plaintiff shows—

(B) by clear and convincing evidence that the manufacturer failed to exercise due care notwithstanding its compliance with such Act and section (and regulations issued under such provisions).

Yep. And as someone who has had adverse reactions to things, I'm super stoked we are headed towards mandatory vaccines. For coofs.

There is a vaccine injury fund provided by the government. But this little piece of work removes a lot of incentive to ensure patient safety from vaccine manufacturers.

Ah yes, the classic "we'll take the benefits but foist off all the risk to another group".

This legislation must be repealed asap after DJT is confirmed as POTUS

Then, every Pharma executive should discover what a mandatory vaccine means, to be administered, with prejudice by a hairy-arsed Marine.

The way this legislation came about is infuriating.

They went to congress and whined that liability costs were bankrupting them, so pretty please could they get granted immunity from prosecutions for all harm done. An incredibly stupid question to even pose, since they are admitting they are a non-viable industry doing tremendous harm.

But far worse, congress agreed which is how this mess came about. I'm sure not a single dollar or stock option changed hands over the course of this negotiation.

Well if the corrupt laws are going to protect them from punishment, I guess you'll just have to go and punish them yourself.

Four decades without a vaccine for HIV. Shortest time from discovery to a vaccine was 4 years. Less than a year for a COVID-19 vaccine? No thanks.

Yep. There is a vaccine claims court (administrative court) - where you can go and maybe get some money damages - from the adverse effects of a vaccine. The appeal goes to the court of appeals for the federal circuit.

Its beyond the pale that anyone would think it reasonable to mandate an injecting foreign materials into a person against their will, with nobody being held responsible for adverse outcomes.

My body my choice? Oh.... not anymore?
