I don't believe that's correct. Once certified to take office, the death of the President elect is treated as the death of the President in office. So Kamala would take the office.

It would just be the vice president elect that takes over. I agree Biden has dementia and doesn't look good at all if he won kamala would be president.

I'm saying "if" he won I think the vice president would become president on Jan 20. I think we all know Biden lost. There's still a ton Trump can do to turn the election around.

Seriously idk. Rumors are his inauguration will not be public or at the white house. He has supposedly hired his own security ( not using secret service). All sounds kinda odd.

I looked this up, because I had a similar question. (I.e.: Biden is forced to step down due to criminal activities before the election is decided.)

I discovered there is literally no historical, legal precedent.

The best the Constitutional lawyers could come up with is that it falls to the individual states. Each would have to decide if they recognize the VP as the presidential candidate.

If not enough do, the VP is out.

Once the votes are certified, which they technically are, the 20th Amendment Section 3 applies to both the current President and the certified President elect.
