I think he can just use the insurrection act without the EO or maybe any report that the DNI can knock up without the IC will be sufficient. If these IC actors are on side then the delay might be for a good reason

At this point all he has to do is put a power point slide together and put it on trump's desk. He doesn't have to make a public report. He is doing so for OUR benefit. NOT for trump.
