Because this says that the assessment shall be conducted within the 45 days after an election.
And that's just the start date. There's no time limit for the assessment. The investigation could take years. And then once it's done, they have 45 days to give a report to the President, etc.

I think they have another 45 days to give it to Pres But I’m sure Radcliffe only needs to give an assessment for the E/O to be permitted
