I'm sick of this "we have to avoid the perception " argument
It's not an "argument", it's a judicial standard and it doesn't matter if you're sick of it. It only matters what a judge thinks when an accused makes a plausible argument that he was only prosecuted because the president is trying to consolidate power. Because political prosecutions aren't allowed in a free country.
Yeah and you would think 10% of our states wouldn't be able to conspire in stealing a Presidential election yet here we are. As for legal proceedings, we are operating in the court of public opinion and as such, we can say whatever we want knowing full well whatever we say we will be spun by the enemy media.

And while you are trying to figure out a plausible argument to take to judge so they can laugh at you and refuse to hear your case like they have with all these election fraud cases the state is busy finishing turning this nation into a CCP like oligarchy.
If President Lincoln cared what mattered to judges as you say then the nation would have been split into 3 or more factions and the Civil War would have gone down differently.
