That’s exactly right, no where does it say a public report is due in 45 days. Only an assessment to specific persons. And we know that Ratcliffe was with Trump at the Army/Navy game. I personally think the assessment was already given.

The assessment was due to the president and other listed officials within 45 days. Nothing says that the rest of the world will have access to that information.

Correct.

The EO is the presidents orders. It's not a legislation that he must follow.

Trump is saying X Y and Z must happen. If X fails, it doesn't mean that Y and Z suddenly stop.

All it means is someone might get fired for failing to obey his EO.

No more than 45 days after the election to complete the assessment and then no more than 45 days after the assessment should recommendations be made.

I agree. Assessment is not the same as physical comprehensive report. The assessment could result in ongoing actions, a memo, a presentation, meeting ...

It says the assessment shall be completed within 45 days of the conclusion of the election. ODNI has referenced that they see this date at 12/18 (45 days after 11/3), as they said they were going to miss it.

Based on that the latest we would see a report would be early February.

EO13848 SEC.1 (d) Nothing in this order shall prevent the head of any agency or any other appropriate official from tendering to the President, at any time through an appropriate channel, any analysis, information, assessment, or evaluation of foreign interference in a United States election.

This says there is no deadline to "tender". Meaning the report is not due the 18th they just must make an assessment by this time.

Edit: also the inclusive report including all agencies under the DNI is not the only way for information to land on his desk

Yes, however they go on to say they've received "relevant reporting", according to the EO which also says that any information found should be reported then if info is found after the report can be amended sec. 1 (c)... not saying the DNI is not late but there really is not a true deadline for this report.

I'm not sure what you're arguing.

ODNI, the people in charge of the assessment and report, said they're going to miss the deadline. I agree that a "deadline" is not well defined in the EO but the people in charge said they're going to miss it.

The assessment could also be to determine what action if any to take, not just information for a report. Trump most likely has to decide whether to enact the insurrection act, or take another action within a certain amount of time.

In 2018 he probably had a good idea of what would happen during the election but he might not have known of the pandemic and mail-in voting so he needed the DNI to look into the evidence gathered within 45 days after the election to determine what steps to take. The assessment is meant to determine if and what actions he needs to take, and upon whom and what.
