As a libel lawyer, he also thoroughly understands the incredibly high bar one has to overcome to succeed in a libel suit when you're a public figure. I'm sure he also understands that SC Justices do not engage themselves in private litigation or political issues. He could have just made it up and still be nearly 100% certain no lawsuit is coming.
