That "if no one gets 270" thing is a mis-interpretation. If a states votes are tossed out completely, the winner is still whoever has a majority. 270 comes from dividing 2/538 total votes + 1. If all 538 votes are counted and there is no majority, which is only possible in a 269- 269 tie, THEN the vote goes state houses.
but if you toss out 38 votes that don't go to either candidate, then whoever gets 251 votes wins the election.
