Every institution whose function is to prevent election fraud whether it is the courts, state legislatures, the GOP or law enforcement arresting those who engaged in it have simply failed to do their job. This is either because they are corrupt and complicit in the steal or too cowardly to do their job.
Every institution has broken down allowing total lawlessness to prevail. When laws do not matter or are not followed by those in power then it cannot be expected that the serfs will follow laws either.
Why would it be unconstitutional? Is January 6th even in the constitution? The only date that matters should be inauguration right? If trump has proof of fraud and every other avenue to get that proof out has been blocked by the system. Why can’t he use the insurrection act post Jan 6th? He’s still the president.
Because Jan 6 is when the electors give their votes and that is the moment the next president is actually decided. If Biden gets the Elector votes he is the next President and anything Trump does after that is going against someone who is actually President Elect.
I know what you're saying and I'm with you but please understand what I'm saying. Anything is possible until the 20th technically that is true but whatever happens after the 6th will be done against someone who has a legitimate claim to the presidency if he gets the Electoral votes.

I want Trump to invoke the Insurrection Act now and halt this process until the military conducts a full recount/audit of the votes in contested states. I believe that we are setting ourselves up for failure if we let Jan 6 happen.
Maybe you’re right. But still. He’s not president until he’s sworn in on the 20th. Until then trump is still president. In light of what has happened in this election, invoking the insurrection act, seizing machines and ballots and figuring out what actually happened in this election is protecting the constitution and a duty of the president.

I don’t think he has to do it before the 6th, because of the executive order on election interference.
