Not really. If Trump preempted the fraud or acted on it before the fraud was well-documented, he would have been seen as making unilateral, even dictatorial moves. Now he has basically half the nation begging him to do something drastic.

Remember how the Wall started. Trump began by negotiating with Congress. He probably knew it was pointless but he went through the motions to justify using the military, which may have been his plan all along. Similarly, Trump may have already decided on using the Insurrection Act but has gone through the motions (courts) and gave everyone a chance to save themselves so that he seems more fair and justified when he invokes the Act.
