Sooo IDK what state you are in ..but bankruptcy is an option to buy you time to save your house BUT timing is everything. I'm not attorney - so ask one. If you are in Texas.. ouch.. fast turn around.. like 21 days foreclosure process so you don't have time for denial (most people take long in the denial phase) .. but in a western state like CA there are 2 phases.. the NOTICE OF DEFAULT phase and that is 90 days.. then the NOTICE OF TRUSTEE SALE.. that is only 21 days.. but doesn't get initiated right after the 90 days.. so how ever long it takes the bank to file the Notice of Trustee Sale... SOOOOOOOO get a Bankruptcy atty or you can file yourself if you look up how to do it.. BUT you need to file in the first phase! File on the 88th or 89th day...(Count from when they file stamp the Notice of Default) then you had 3 months of no mortgage payment.. but what happens is the BK basically cancels the NOD.. and then the bank has to get permission from the BK court to file the NOD again.. which that probably takes about a month or longer.. then they file the NOD...and that's another 3 months you got.. so far that's 7 months! .. AND The court has to approve them taking it to auction.. maybe you can do a reorganization.. like a Chapter 13.. or clear your debt a chapter 7 .. right.. it's actually in the bible to clear debt every 7 years.. that is literally where they got the 7 years. Don't feel bad.. it's a tool to help people. I've had to do it. Banks have taken advantage of people.. so if not you.. they certainly did someone else.. and Bank of America is the worst .. big crooks.. remember they gave credit cards to illegals and then surprise they didn't pay it back. AND I just can't imagine the BK court not taking in this pandemic as a consideration to help people.
