If the military has evidence of his communication and connection to China there is still time and a way for state legislatures or congress to stop it, which they would, if the military came out publicly with it or briefed those politicians. That is such damning information. There is no path forward if the military were threatening to do that.
And if there is no path forward to the presidency and the pardons then Team Biden risks jailtime. So one can see how conceding and taking the deal might be the best choice.
