I read the referenced court cases, they are referring to naturalized (becoming a citizen through taking the test and completing all the requirements) or citizen by birth (being born here) but I cannot find anything that states that your parents must also be born here.

I must be missing something?

I'm pretty sure she can though. I can't find anywhere that says your parents have to be born here. As long as you're a citizen, and you were born here, you can be president. That's considered "natural-born". Naturalized, as in that court case v. Wong, is not the same thing.

I think OP was wrong and I think you're wrong too.

I still don't like Kamala Harris but I think this whole concept of your parents having to be born here is bunk. Unless someone can show otherwise.

It is in the 14th Amendment in the words 'All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens'.

Children born to foreigners owe allegiance through their parents to another jurisdiction (as subjects of another nation), and the US demands full jurisdiction for natural born citizenship. The parents certainly couldn't be considered to be 'subject to the (sole) jurisdiction' of the US if they never agreed to repatriation. They are visitors, citizens of their origin countries. And according to our Constitution, for 'natural-born' the parents both needed to be citizens, fully subject to sole jurisdiction, before the birth.


Here you can see that just last year (Oct. 2019), they rewrote the California law regarding citizenship, which had excluded 'children of transient aliens' for over a hundred years. So unless Kamala was born yesterday, she's illegitimate and she knows it.

This isn't true. There as been some dispute about what "natural born citizen" means. In the old understanding it was strictly someone who was born on US soil, parent citizenship doesn't matter. In the new understanding it can be foreign born US citizens who were US citizens at birth because one or both parents was a US citizen.

There's been some official clarification since 2011. This would qualify both Heels-Up and Ted Cruz to be president. This is basically a non-issue. Kamala shouldn't be allowed because she's a fucking traitor to the American people through her actions.

in 2011, the non-partisan Congressional Research Service issued a report stating:

“The weight of legal and historical authority indicates that the term ‘natural born’ citizen would mean a person who is entitled to U.S. citizenship ‘by birth’ or ‘at birth’, either by being born ‘in’ the United States and under its jurisdiction, even those born to foreign parents; or by being born abroad to U.S. citizen-parents; or by being born in other situations meeting legal requirements for U.S. citizenship ‘at birth.’”

Why not quote the part from the Wong decision which you think sets this precedent? I don’t see it. 680 references a decision from another case, which states that children born (in country) to citizens of that country are natural-born citizens, but it doesn’t state that this ‘natural-born citizen’ status belongs to this group exclusively. ie. Stating that an alsatian is a dog doesn’t mean that only an alsatian can be a dog.

The decision also talks about needing to look at English common law to discern the meaning of certain terms, and after doing so states:

“It thus clearly appears that, by the law of England for the last three centuries, beginning before the settlement of this country and continuing to the present day, aliens, while residing in the dominions possessed by the Crown of England, were within the allegiance, the obedience, the faith or loyalty, the protection, the power, the jurisdiction of the English Sovereign, and therefore every child born in England of alien parents was a natural-born subject unless the child of an ambassador or other diplomatic agent of a foreign State or of an alien enemy in hostile occupation of the place where the child was born.

III. The same rule was in force in all the English Colonies upon this continent down to the time of the Declaration of Independence, and in the United States afterwards, and continued to prevail under the Constitution as originally established.”
