That's great, but in case you haven't noticed, our government doesn't really care about the constitution or upholding the law anymore. If they're willing to let an election be stolen and be potentially undermined by a communist government, then they'll never fight against this. Just look at Obama.
this would be an open and shut case if these people followed the Constitution -- but they are convinced they're above it -- keep spreading it anyways and hopefully it gains traction
BOTH Parents must be citizens of the USA at the time of the birth on this soil, or during a time of war, areas deemed American soil. Since the Founding of this Constitution.
The same Scotus that swore in a Non natural born citizen? For 13 years been trying to get people to read about Natural born citizen. We are a Country of Laws not opinions. Facts matter.
You don’t understand. They know all this. It is the leverage they have over her. It’s why she (and Joepedo) were selected and why the leftists coordinated and fought so hard for them.
I screamed this last July. No one was listening. Oh, and Kamala-toe is NOT Black. She is Indian and Jamaican. INELIGIBLE for VP OR POTUS.
Her family was the largest owners of slaves in Jamaica. She is a FRAUD and A C*NT.
No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President. There clearly is a difference in Citizen and natural born citizen. One must be born with sole Allegiance to the USA, to become CIC.
Our Native Country: The citizens are the members of the civil society; bound to this society by certain duties, and subject to its authority, they equally participate in its advantages. The natives, or natural-born citizens, are those born in the country, of parents who are citizens.
In drafting the United States Constitution, originally the requirement was No Person shall be eligible to be President of the U.S unless he now be a citizen of one of the States, or hereafter be born a Citizen of the U.S. After reviewing the Draft, the question presented then is whether the U.S is willing to allow persons who were born without sole allegiance to the U.S to be Commander in Chief of Our Military. For this specific fear that prompted our first Supreme Justice John Jay-to suggest to George Washington the following: "Permit me to hint, whether it would be wise and seasonable to provide a strong check to the admission of foreigners into the administration of our national Government; and to declare expressly that the Commander in Chief of the American Army shall not be given to nor devolve on, any but a natural born Citizen.
The 14th Amendment was ratified on 1866: John Bingham confirms that understanding and the construction the framers used in regards to birthright and jurisdiction while speaking on the civil rights of citizens in the House on March 9, 1866'[1] find no fault with the introductory clause [S 61 Bill] which is simply declaratory of what is written in the Constitution, that every human being born within the jurisdiction of the United States of parents not owing allegiance to any foreign sovereignty is, in the language of your Constitution itself, a natural born citizen.."
With all the ways Pelosi could become interim president or "actual" president, have we all been focusing on biden/harris and not realizing the entire plan was to have her in the white house?
I read the referenced court cases, they are referring to naturalized (becoming a citizen through taking the test and completing all the requirements) or citizen by birth (being born here) but I cannot find anything that states that your parents must also be born here.
I'm pretty sure she can though. I can't find anywhere that says your parents have to be born here. As long as you're a citizen, and you were born here, you can be president. That's considered "natural-born". Naturalized, as in that court case v. Wong, is not the same thing.
I think OP was wrong and I think you're wrong too.
I still don't like Kamala Harris but I think this whole concept of your parents having to be born here is bunk. Unless someone can show otherwise.
It is in the 14th Amendment in the words 'All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens'.
Children born to foreigners owe allegiance through their parents to another jurisdiction (as subjects of another nation), and the US demands full jurisdiction for natural born citizenship. The parents certainly couldn't be considered to be 'subject to the (sole) jurisdiction' of the US if they never agreed to repatriation. They are visitors, citizens of their origin countries. And according to our Constitution, for 'natural-born' the parents both needed to be citizens, fully subject to sole jurisdiction, before the birth.
Here you can see that just last year (Oct. 2019), they rewrote the California law regarding citizenship, which had excluded 'children of transient aliens' for over a hundred years. So unless Kamala was born yesterday, she's illegitimate and she knows it.
This isn't true. There as been some dispute about what "natural born citizen" means. In the old understanding it was strictly someone who was born on US soil, parent citizenship doesn't matter. In the new understanding it can be foreign born US citizens who were US citizens at birth because one or both parents was a US citizen.
There's been some official clarification since 2011. This would qualify both Heels-Up and Ted Cruz to be president. This is basically a non-issue. Kamala shouldn't be allowed because she's a fucking traitor to the American people through her actions.
in 2011, the non-partisan Congressional Research Service issued a report stating:
“The weight of legal and historical authority indicates that the term ‘natural born’ citizen would mean a person who is entitled to U.S. citizenship ‘by birth’ or ‘at birth’, either by being born ‘in’ the United States and under its jurisdiction, even those born to foreign parents; or by being born abroad to U.S. citizen-parents; or by being born in other situations meeting legal requirements for U.S. citizenship ‘at birth.’”
Anchor babies, anyone? People born on U.S. soil are natural-born citizens in the eyes of the law, for my entire five decades on this planet. That is why they are called anchors, since as I.S. citizens, the parents then claim the right and the financial benefits to stay and raise the children born over the border. Fuck Congress. Anchor babies draining the national economy pose a national security issue since military funding is impacted. Sign an Executive Order refusing to recognize the legitimacy of anchor baby citizenry.
"some experts have suggested that the precise meaning of the natural-born-citizen clause may never be decided by the courts because, in the end, presidential eligibility may be determined to be a non-justiciable political question that can be decided only by Congress rather than by the judicial branch of government"
You're right, but this will go nowhere. It's been accepted that anyone born in this country is a natural born citizen. It's not right, but that's how it works in real life.
Fake news helps no one. Please, keep your focus on the target and do not get sidetracked into conspiracy theories. Does it help us stop the steal or not? This is a debunked theory (I work in immigration). We need to put our energy into legit plans and actions.
Why not quote the part from the Wong decision which you think sets this precedent? I don’t see it. 680 references a decision from another case, which states that children born (in country) to citizens of that country are natural-born citizens, but it doesn’t state that this ‘natural-born citizen’ status belongs to this group exclusively. ie. Stating that an alsatian is a dog doesn’t mean that only an alsatian can be a dog.
The decision also talks about needing to look at English common law to discern the meaning of certain terms, and after doing so states:
“It thus clearly appears that, by the law of England for the last three centuries, beginning before the settlement of this country and continuing to the present day, aliens, while residing in the dominions possessed by the Crown of England, were within the allegiance, the obedience, the faith or loyalty, the protection, the power, the jurisdiction of the English Sovereign, and therefore every child born in England of alien parents was a natural-born subject unless the child of an ambassador or other diplomatic agent of a foreign State or of an alien enemy in hostile occupation of the place where the child was born.
III. The same rule was in force in all the English Colonies upon this continent down to the time of the Declaration of Independence, and in the United States afterwards, and continued to prevail under the Constitution as originally established.”
That's great, but in case you haven't noticed, our government doesn't really care about the constitution or upholding the law anymore. If they're willing to let an election be stolen and be potentially undermined by a communist government, then they'll never fight against this. Just look at Obama.

Yep. Bathhouse Barry!
He also alleged that his wife didn't have a cock. Hussein-Obama's word doesn't mean shit.
It's TRUE you can fucking keep that rag head apologist in chief in charge for 8 years you can keep this prostitute as vp. All fucking bullshit
I thought she was ineligible because she is a nasty hoe twat...
Problem is, Cruz is ineligible as well then in the future
It's true. No exceptions. He's not ineligible for SCOTUS though.
Would be more based than any other judge on there
Yes. And willing to fight.
He should be ineligible for being the zodiac and a liar
and that's on her good days.
this would be an open and shut case if these people followed the Constitution -- but they are convinced they're above it -- keep spreading it anyways and hopefully it gains traction
We now have a piece of parchment in the National Archives.
BOTH Parents must be citizens of the USA at the time of the birth on this soil, or during a time of war, areas deemed American soil. Since the Founding of this Constitution.
Not true, read the SCOTUS case OP linked, they only have to be permanent residents
The same Scotus that swore in a Non natural born citizen? For 13 years been trying to get people to read about Natural born citizen. We are a Country of Laws not opinions. Facts matter.
Does this line address that?:
[Of course, this is a quote, not a sworn statement]
Well not really, her intention isn’t enough I wouldn’t think, this would be referring to legal status.
Actually it is.
Law was clarified in the 70's to include US territories and bases.
This isn’t true. I was born in the US to immigrant parents and I’m a citizen who is eligible to run for office or president.
Sure, THIS will be the Constitutional law the courts uphold.
You don’t understand. They know all this. It is the leverage they have over her. It’s why she (and Joepedo) were selected and why the leftists coordinated and fought so hard for them.
Well, Obama got away with it, so there's that as a precedent.
I've done my share of research on Obama's citizenship. He recently bragged that he got away with it.
Right. Her ineligibility for the office is much more clear than Obama's was.
I screamed this last July. No one was listening. Oh, and Kamala-toe is NOT Black. She is Indian and Jamaican. INELIGIBLE for VP OR POTUS. Her family was the largest owners of slaves in Jamaica. She is a FRAUD and A C*NT.
I respect your candour
No fucking way that's real, lol.. holy shit.
In 🤡 🌍 doesn’t matter at all.
Neither was obama

Okay, and? Who’s going to do something about it?
So Pelosi becomes Prez if Congress does not select a new VP? It is Congress that makes the selection, right?
Be careful what u wish for.
With all the ways Pelosi could become interim president or "actual" president, have we all been focusing on biden/harris and not realizing the entire plan was to have her in the white house?
Kamala is an anchor baby
Sadly it doesn't seem to matter. Our Constitution is toilet paper. SCOTUS wouldn't do that.
Didn't matter with Obama, don't expect it to matter now
At the time of my wife's birth, no one in her family was a citizen. She is most definitely a citizen.
What am I missing here?
And no they weren't here illegally before anyone starts with that BS.
I read the referenced court cases, they are referring to naturalized (becoming a citizen through taking the test and completing all the requirements) or citizen by birth (being born here) but I cannot find anything that states that your parents must also be born here.

Yes she can
If Harris was born in the U.S., she is 100% a U.S. citizen. That is in the 14th amendment.
laws mean diddly doo doo in 2020

"new understanding" "non-partisan" Obama-era
wonderful news , i'm sure the SCOTUS will immediately convene and throw her out , in just the same fashion as they accepted all the Trump fraud cases
You’re acting like they care

correct me if I'm wrong but I have always been under the impression anyone BORN in the US was automatically a natural born citizen
Gov't doesn't care about the law.
Le sigh
idk. I know wikipedia has been dominated by leftists.
https://en.wikipedia.org/wiki/Natural-born-citizen_clause
"some experts have suggested that the precise meaning of the natural-born-citizen clause may never be decided by the courts because, in the end, presidential eligibility may be determined to be a non-justiciable political question that can be decided only by Congress rather than by the judicial branch of government"
seems a difficult question to resolve.
Were her parents permanent residents? Seems like that’s all that matters
No
Oh well then boom
I’m all in for any solution that avoids listening to xer caking voice...
Luckily we’ll never get to that.
Isn’t the same situation about Ted Cruz being eligible or not?
It takes a village.....
Has she still not resigned her Senate seat? Or is she recall after Gavin Pelosi?
You're right, but this will go nowhere. It's been accepted that anyone born in this country is a natural born citizen. It's not right, but that's how it works in real life.
Nobody cares, we already had our first Kenyan born president that also eats chorizo.

You cant nationalize people like this.
Who cares about evidence or even to check? That's not how it works anymore.
Not to be a Debbie downer but if she was born in america she's considered a citizen
Why not quote the part from the Wong decision which you think sets this precedent? Muh Anchor Baby Doctrine would disagree with you.
Yeah and barry was born in america as well
Our founding fathers wrote into the constitution "absolutely 100% no purple cabbage as president the oval office has no ventillation"
and she's a woman. Everyone knows a woman can't be president.
Go back to doing TaeBo.
