His plan was for the election to be decided in the courts. He didn't expect them to simply refuse to hear any case no matter how much evidence.

The majority belongs to the party not the specific Senator. The Senator members of the party decides who is the Senate's leader. This makes a difference if Trump is rightfully re-elected by the electors. Imaging Trump being re-elected President and Schummer becomes the Senate leader.
