You would need a Supreme Court that followed the law in order to get that finding. Not real confident in SCOTUS at the moment.

Agreed! Like violence at a protest makes it a riot, not a mostly peaceful protest, this can't be line item vetoed, it can't also be partially constitutional. Thats the problem with these huge bills versus individual bills, one unconstitutional thing makes the whole bill unconstitutional.

That’s the way I understand it. I don’t have confidence it will be held to that standard. I’m not a doomer but I’m a realist usually. If I was a realist always I’d be sad always. Last 4 years were unreal. Lot got done. Let’s not give up. I need to get to DC. It’s a super bad time for me. I’ll try anyway. I need work. Might have a job kicking off around then. I got screwed hard on work this year but didn’t take any of the unemployment crap. Maybe that was stupid. I still have my pride. If the bid falls through I might can go. By then, I’ll likely have to drive. I’d rather not have my Truck there. I’ll figure it out.

It is NOT in the Constitution. It's a federal law passed in 1807.

Trump may have other Presidential powers and certain other abilities according to the Constitution, but the Insurrection Act specifically is not a Constitutional power.

congress has the power to declare war; the insurrection act gives the president the unilateral authority to declare war against armed rebellion/insurrection.

The president can have the cia/special forces assassinate terrorists; so he could classify the communists as domsestic terrorists and kill off their leadership, but I believe he needs specific authorization to do this domestically from the gang of 8 and the SC.
