There are 7 contested states who sent dueling electors.
why is New Mexico flying under the radar?
If we count them all, Trump wins. If we don't count them all, Trump wins. If we take out any single state, Trump wins.
Only the party electors of the candidate who won count, unless they get rejected by the VP or rejected in a private session based on a challenge.
The R and D leadership are likely to avoid a contingent election based on disagreement. They are more likely to toss one or two states, and give the win to Biden to avoid a contingent election.
The entire point of the Pence Card is the recognition that there is no R card, no contingent election card likely to be played.
I got a little excited, and I'm struggling to find the article. I got it from TD, and trying to search for anything in a search engine leads to bullshit recent articles. So there were multiple times that electors were sent without certification at all, or with improper certification, or where alternate electors were suddenly allowed at the last minute, or where the certification was questionable, and every single time, the President of the Senate included those votes in his count.
So I'm saying, there is precedent for Pence to just count both sets for every state. Then both houses of congress would need to agree to overturn his decision.

My understanding is the alternate electors are useful and counted if the primary party electors become void due to the VP rejecting (possible but hasn't happened) or a challenge (has happened), or a finding of a late different winner happens when a recount is not possible in the time window or ruling of fraud by a court. The congress can reject electors, but cannot create them, so the alternate electors become valuable in any of these cases.
A recount swung HI from Kennedy to Nixon in this way, but the congress still gave HI to Kennedy because no challenge was made because it would not have tipped it all to a win for Nixon.
This is why Miller said sending alternate electors leaves legal doors open. They do not count though unless congress challenges the original party elector ballot slates.
There is not deadline for Pence today. The states have to have their votes delivered to Pence today. It's a deadline on them, not Pence. Pence has until Jan 6th.
