Dear Mr.

Thank you for contacting me to share your concerns about the 2020 Presidential election. This year has been one of the most difficult in most of our lifetimes. Too many have been lost to COVID-19. Too many people lost their jobs, businesses and homes because of the governor’s administration’s response to the virus. And a contentious presidential election left many of us questioning the integrity of our election system.

As your state senator, I want to ensure that you, the voter, have complete and total confidence when heading to the polls to vote. Election security is the basis of our Democracy. That is why my colleagues and I in the Legislature wasted no time to begin an investigation into the election and Michigan’s election processes. Subpoenas were issued, records of retention were sent to clerks, President Trump’s Legal team, Dominion, and the state’s former elections director of 36 years who helped oversee voting and poll challenges at the TCF Center last month were questioned thoroughly. Across these multiple days of testimony, the Senate and House Oversight committees have heard from countless individuals who have made serious claims of election fraud, irregularities and intimidation that may or may not have affected the election outcome. The purpose of these committees is not to overturn the results of an election, but rather to review state processes and pursue opportunities for improvement.

In addition to the investigation, I co-signed a letter with numerous other senators and representatives formally requesting that an independent forensic audit of the election be conducted. If there is fraud it needs to be found and anyone who broke our election laws needs to be prosecuted to the fullest extent of the law. Secretary Benson recently announced a statewide risk-limiting audit along with the routine local procedural audits that will review the accuracy and process of elections in local communities. I look forward to reviewing the results next month and appreciate the work required by our local clerks to carry out these audits.

While we await these results, the full Antrim County hand-counted audit has been completed and resulted in 11 more votes for Trump and one less for Biden. The minor differences in counts were in line with what is typically seen in hand recounts and the totals were so close we now know errors were unrelated to tabulation.

Over the past few weeks I have also had the opportunity to speak directly with local clerks, election officials, and constituents to truly understand what happened on election day. I appreciate their valuable input.

The state’s constitution and election laws are clear in that, for a Presidential election, the certified winner of the state’s popular vote is to receive all the state’s electoral votes. There is no mechanism in our state for the Legislature to overturn that result, reject its certification, appoint new electors or otherwise usurp the electoral process. Amending state laws, including election laws, requires the Governor’s signature. The constitution does allow election results to be challenged and that is handled strictly through the court system. To this point, however, Michigan courts have not found any claims of widespread fraud to be legitimate. Candidates may also request a recount in certain circumstances, though the Legislature plays no role in that process.

The Michigan Electoral College recently met and cast their votes for Joe Biden and Kamala Harris, certifying Michigan’s 16 electoral votes. The next step in the process is for the United States Congress to officially tabulate the votes on Jan. 6. As a member of the Michigan Senate, I do not have any jurisdiction over the tabulation.

The general election of Nov. 3 was unlike any experienced in decades. One of President Trump’s legacies may be shining a bright light on the serious vulnerabilities in our elections process. This year has made it clear we must strengthen our laws, especially in this new era of greatly expanded absentee voting, same-day registration and other changes in voting laws.

There remain unresolved problems that must be addressed. We all must be able to trust the integrity and outcome of not only this election, but every election and I will not rest until we can.

Thank you again for contacting me about this important issue.

Sincerely,

Kim LaSata

Their smug, deceitful responses anger me to no end. Well there's one more commie, swamp scum to kick out as soon as possible. May they rot in hell for violating the sacred rights of American voters.
