I just feel like we are totally screwed with this scenario... after they convene for two hours.. if a small minority... like Romney... and that RINO in Maine... go to the democrat side in the senate. And both houses vote yes, pence can’t deny certification...
According the the constitution yes... but... democrats only follow the constitution when it’s convenient to their cause. I assume pence could say no, and force a 12th amendment vote... but I doubt he will. Nancy And McConnell will demand he certify, if both houses get a majority vote.. they will probably refuse to perform the 12th
Bear in mind, the only set in stone date is Jan 20th, 2021.
On more than one occasion in the past, electoral votes were counted later than the 6th. I think, though I would have to do some digging to double check, the latest they were counted was the 16th of January one year back in the 1900s.
