Frankly, the Texas thing was a bit of an out of left field thing. There was never any plan by the Trump team to hit SCOTUS that early or with something totally unprecedented. There are some smart people out there that believe SCOTUS nixed it because it would have messed things up and muddied the waters a bit.

Trump and his team, as having clear standing and a path to remedy, are the only people who should be bringing a case, so that it is a clean, clear situation that SCOTUS can rule on.

I'll reserve my judgement of SCOTUS until everything plays out, but so far, everything is on the original schedule so I see no reason for everyone freaking out right now.

If they don't take up the case, then they are completely compromised. I doubt they are. They can't use the "standing" excuse this time, and I still believe they used that to get the Texas thing to back off so they can focus on the real case brought by Trump, who has direct standing.

I'm sorry, as excited as we all were (including me), about the Texas case, it really did have the potential to cause problems for Trump. Even the lefties on the Court can handle multiple cases at once, but stuff like this needs to be isolated and nothing else diverting their attention. Too much is on the line. And frankly, the Texas case brought up a lot of unresolved questions dating back to 1861, basically how sovereign are the states, and when and if they can file a grievance with the Court.

And I think the judicial philosophy going forward has been "don't answer that question", because it could very well destroy the union for good. It's better to "pretend" there is an unbreakable bond, than to really dig at the heart of the question and answer it, because the Founders really didn't set that union in stone very well, probably for good reason.

Hell, the entire Civil War was constitutionally illegitimate. There's is nothing in it that says states can't just leave. That is the real reason they never tried Jefferson Davis for treason, because it would have forced the court to answer certain questions that might prove the Civil War was unjustified. And that has still not been remedied. And I don't know why.

But yeah, the court doesn't want to touch something like the Texas case, and I totally get why. I don't think it's right, but I get it.

Not the Kelly case. Trump v PA Boockvar. Docketed on 12/23. Don’t see any further info about it re action before 1/6. But it’s challenging the lower court ruling from 10/23.
