That's what happened here IIRC, a business rival of the dude paid off a health inspector and got his violations overlooked and got the other guy shut down. So a really obvious case. Dude sued, and they bankrupted him fighting the suit. he never got paid.
As it stands now, we are all definitely suffering abuse of power under cover of authority. The question is how best to sue? I would like to see small businesses mount a lawsuit against the governor for his EOs (and every city and official that enforces them named in the suit as well). We now have more than enough studies showing masks don't work. And social distancing doesn't work either. So we have a case.
We also probably have a due process case, as we are being deprived of liberty and property (assets) without due process of law since most of these things are EOs or regulations, not legislation. On the SCOTUS level, there may be a case to be made along the same lines with regard to the ever changing rules, and sheer number of regulations enforced with no legislative foundation and enforced unequally, with some classes of business "non essential" and some "essential".
