It is..and..if you think about it..u might see rationale behind SC not taking case..because there is already a constitutional solution of rejecting disputed electors. It does put the burden on pence to act though.
But hey..if it was good enough for thomas jefferson to elect himself..it should be good enough for pence to elect trump. We'll see
