why was she arguing saying that the mall isn't private property? that's one point where the security guard is almost certainly correct - that the mall is private property.

As far as 1st Amendment issues, which this entire thing is about, it is NOT private property. It is considered Public Property, in the sense that you are not entitled to rights afforded to you, if you were on Private Property.
