Seems like its all conjecture, and muddy waters.

What can Pence do on the 6th? So both houses object. What then? 2 hour debate. Ok, after that? Dems hold the house, that wont go our way.

How can the vote be thrown to the house?

The House only votes en bloc in the Contingent Election phase, not in the Electoral College phase.

If this goes to an amendment xii process you are correct.

pence throws out fraudulent votes, counts trump votes that contested states also sent

dems object

pence's vote of the electoral college is thrown out

house votes, one vote per delegation, to elect the president

Trump wins.

Or the dems don't object and trump wins. Or Pence counts the fraudulent votes, rep congress members object and somehow during the 2 hour debate that follows, enough dems are convinced there was election fraud to vote to object and then we are back to a house vote, one vote per delegation (this last route is unlikely to work unless Trump has something really damning to show to Congress - which he probably does but even that would not change the dems' minds, they live in their own reality and will ignore all evidence just to see Pres Trump gone)

The VP / President of the Senate has sole Constitutional authority to “count the (electoral) votes.” He, and he, alone, gets to decide whether to accept or reject state electors. If he does the right thing he will throw out all the votes from GA, PA, WI, MI, and AZ. Then neither candidate gets 270 and we have ourselves a contingent election in the House.

So he can throw out electoral votes? I think thats what everyone expects, but I dont see that in our constitution.

12th amendment doesnt say approve of votes. Im not familiar with electoral count act. Does it say the President of the Senate can dismiss votes?

You are right. I don’t get why people don’t understand this. I am praying for the win and won’t give up but a lot of disinformation here which just isn’t accurate.

Thank you for telling the truth.

The truth is, the Constitution doesnt specify. Congress wrote an act with all the details, but that act has never been challenged judicially.

My estimation is that Republicans don't have the votes to force acceptance of the alternate slate of electors, but it might be possible that Pence rules the electors null and void due to the conflict, preventing Biden or Trump from reaching a majority, and thus throwing the election to the House.

I hope this is the case. Seems most constitutional. I cant read that the VP can toss votes in the 12th admenment

He can’t toss votes. Trust me I wish he could, but not sure why everyone keeps saying he can. It doesn’t work that way.

saw it - for me its muddy waters on the course Pence can take on the 6th. I think Louie Gohmert (whom I love) is unclear also. Its really not spelled out very well
