I dont think Pence is gonna do anything either and I dont think it looks good if he does. The Ds would just blame the election on him. This has to be resolved in the state houses, that's the only way both sides will say it's legit. Were getting close, PA, GA, WI and AZ are all about to fall.
We already have a contested election now, it wouldn't be far fetched to go ahead with rejecting EC votes from said contested states now that there is support for it within Congress.

I think it was the "pence turns down the lawsuit" part, which signals intent.
Pence also never needed the lawsuit to do what the lawsuit was asking.
