Let's say their social media guy screwed the pooch. Besides having his career ruined can they sue for damages? Like that would be hilarious. I love everything about this situation!!

I think technically they could sue for damages but that may depend on the State as there are worker protection laws that allocate liability when a worker is working on behalf of the company to the company entirely unless there was evidence of mal-intent.

Also, suing for damages would be mostly a pointless endeavor because the employee wouldn't have anything of value.

Also, let's be realistic. The person who made the comment is likely some blue-haired, facial piercing, zelda tattooed soyboy/feminist trans gay loser who the company won't fire because the person is likely feigning some psychological mental health issues due to stress of covid-19 and the Trump presidency so the company fears firing the person over a lawsuit against them. The person is going to simply be given remedial training and perhaps a new job in the company where they aren't responsible for posting anything to the public.

I have 2 local walmarts 1 is in a rural setting and the other is a more 1st and 15th area. That one has many employees with purple and blue hair. They all treat people like shit while the rural walmart is a whole different world.
