Stupid question: why was Pence planning to take a trip during this time in the first place? Isn't he needed on Jan. 6 regardless?

Trip was planned months ago. If Dems hadnt pulled off the biggest cheat in history he would have opened the EC votes, declared Trump and himself the winner and gone on his trip. But then some people did some things......

he was leaving the 7th, the day after, iirc. the media/twatter has tried to portrray it that he was "hotfooting it out of town", as if he was guilty of something. shrugs in 4 years, pence has not made a single false move. he's been loudly supportive of the president. he goes where he's needed, on a moment's notice, seeming with enthusiasm, always with grace and humility...i've never got the impression that he was hungrily eyeing prez maga's chair. if he wants to be president in 2024, he could seal the deal on the 6th. seriously, if he's a black hat, then hollywood lost an oscar-worthy actor.

That does seem weird now that you point it out, frankly I unsure how I missed that obvious conflict. Very strange..

What lawsuit is this one?

It's the one that basically forces Pence to not count the electoral votes from fraudulent states.

More or less, it is declaring he must use his authority or he will both disenfranchise all the voters in the US and face criminal charges by abetting the fraud if it is later determined by the courts fraud did in fact occur.

In other words, he goes from having three options to two -- where he can only certify the problem states for Trump or not at all which leads to a contingent election.

It actually can protect him from losing his position as Vice President since the Senate will decide his fate in a contingent election and they would likely appoint Harris while the House votes for Trump on state majority not representative majority.

That he and his lawyers didn't join in on the case is curious, but probably a safe move to prove he is not biased before the Senate if the court case manages to get thrown out.

Real question here - Every time someone mentions a contingent election, they presume that the Senate would appoint Harris as VP. Why? There's no rule saying that the VP must be a VP candidate, is there? Why not appoint Biden? Hillary? Xi?

To clarify, this case protects Pence from being voted out and Harris in because he will be legally obligated to act a certain way. The Senate would then not be able to use that against him in their deliberations.

Yeah, I've thought the same. Could be a Trump/Biden duo for the next 4. Would be one way to make 2021 even crazier than 2020.

Before they ran on the same ticket, Presidents and Vice Presidents actually ran separately.

They eventually bound the two in the same ticket, because there would be virtually no reason not to do so considering if the President dies the Vice President will take over and a situation where the President is one party and the Vice President is another party would certainly result in an assassination.

Harris can potentially be elected Vice President because the electoral votes aren't hers, they are the President's. If the electoral votes don't add up enough to decide the presidency, then they don't decide the Vice Presidency and then the Senate gets to decide who is in charge of the Senate, which is the role of the Vice President.

This is the “compel Pence to do his job” case. Those on the fence about him can rest assured this case is in the works. Although the Texas cases was great also.
