I've seen that it's okay that he did that (you would have to ask someone more knowledgable than me/browse new if you want to know why sorry). I think he wanted them to direct the suit at Congress as well.

Remember, always wait 24-48 hours for everything to come to light before making a decision about a story. This will all be over in less than a week. Ever think the Dems might be trying hype us against Pence? Remeber how upset everyone got because Pence scheduled a trip to Israel the day after the EC vote....months ago? That was PROOF by gum, that Pence was a deep state traitor. Anyone besides me think its a bit suspicious that this story gets hyped right after Pence cancels his trip, nullifying the previous anti-Pence hype? The lawsuit was a long, long longshot that SCOTUS was NEVER going to hear anyway. By making this statement it puts the other side at ease and makes Pence look like the voice of reason to the normies. The plans are set, what is going to happen will happen, and without the lawsuit. Trump, Rudy, Pence and Pompeo seem very confident it will work. Based on my trust in them, I think it will too.

White House attorneys. They make a fair argument that the lawsuit is un-Constitutional. I know a lot of pedes will lose their shit over that, but they can't rewrite the Constitution at the last minute. Especially as it will have to go through SCOTUS, and we all know the result there.

We'll see. Everyone has turned on Pence, but I'm in wait and see mode. We'll find out on the 6th.

Yep. There's a lot of rush to judgement going on. Gohmert's case is a last minute Hail Mary that will most likely fail - but nobody was depending on this case to win, for the last couple of weeks.

I do tend to think it would have been better that Pence/White House attorneys could have just let the case fail on it's merits, or it's common for requests like this to be made when a case is clearly a waste of effort, and we just never hear about it, but have because this is so high profile.

The effort doesn't stop because this suit fails. Everything Rudy and the White House have been working on for weeks (and months, it seems) are still in play. We're getting down to the wire here, so I understand the freak outs, but I'm trying to stay calm and just try to be rational here. This isn't over by a long shot.

Ah, here is the explanation.

Basically, the lawsuit doesn’t need to be there. There are many things in the Constitution that state he is the sole power of the Senate. He can open votes and throw them out depending on legality. Senators and representatives can object. For 2 hours. There are 6 states in question. This goes to the 12th amendment. House votes by state legislatures for president and senate votes for Vice President independently. We have more legislatures and Pence is more admirable than Kamala. So, we win

Your post isn't entirely accurate. When the contested state goes into a 2-hour debate, both sides of congress have to agree to either count, or toss. If I recall and its a split decision, then Pence can toss if he chooses to and the EV's for that state will not count.
