The Gladiators are a complex subject, of course, cuz obviously, they were around for a long ass time to give them time to change and evolve or devolve.
It's hard to call the false hope of making them fight for freedom cruel and wretched. We can see even now, how many patriots seriously would want antifa and blm thugs to be given the same treatment, not without reason.
The actual letting them go I question how often it happened. It's a fascinating and like most of rome, hard to actually know what was real, or embellishment, piece of history, for what was basically the precursor for modern wrestling and the like. Can't imagine the story lines they weaved back then being much different than modern wrestlings' hilariously bad scripts.
Well not really. Ancient Greeks wrestling is like, actual Olympic Wrestling. An actual martial art still used. I suppose I should've said "Professional" Wrestling, which of course as every one knows, is just glorified big dumb drama shows for men to watch and enjoy.
In a sense, it was sort of a precursor? But not really to the modernized "Pro" Wrestling Scene. You'd see a lot more similarities between the early gladiator fights and say, Hulk Hogan, or GEOTUS punching Steve McMan in the face, lol.
And those punishments might be appropriate, but it doesn't really matter anymore what's appropriate. Like Vlad, people today want to set an example, and well, you'd best prepare to see some evil shit done in the name of Justice, cuz sometimes, in periods of history like our modern decade, shit like that happens.

I would think that prison, execution or permanent deportation would make much, much more sense, depending on what their crimes were. Murdering innocents? Execution. Helping Antifa do terror and murder? Execution. Raping children like one of the wretches attacking Kyle Rittenhouse (see https://web.archive.org/web/20200827203225/https://inmatedatasearch.azcorrections.gov/PrintInmate.aspx?ID=172556 and https://s3.amazonaws.com/jnswire/jns-media/57/7f/11464076/rosenbaumrecords.pdf )? Execution. Helping Antifa in other regards? Possibly permanent deportation.
Another precursor was the ancient Greeks' wrestling, right?
