He's already got that power though - why would he need a lawsuit to affirm it? If anything, if a judge rules against the lawsuit, it would remove his powers/disadvantage him/allow the Dems to make an extra power grab at a different time

Because technically he doesn't have that power. The constitution says he gets to open the votes, not necessarily count them. He does not have the power to throw them out.
