Essentially Pence has this crazy idea that the proper defendant is Congress not the VP since the point of the lawsuit is to recognize that the VP can override Congress. It’s essentially suing VP to give him more authority. As far as i can tell Pence is trying to help by correcting a procedural flaw before the lawsuit is heard.
