Two things. First, if SCOTUS had taken on the Texas case that made the same arguments that Trump did in the tweet about unconstitutional state actions in contravention to their own constitutions, and if it had ruled against Texas, then such an argument by Trump/Pence now would be severely weakened since SCOTUS would have already rejected it. By not acting, Trump/Pence can now make that argument unimpeded by a case finding to the contrary. It also helps push the issue and forces SCOTUS to rule, unless SCOTUS takes up a Pence action and simply rules he had no authority regardless of fraud or state unconstitutional acts.
Second, as noted, it takes up the beauty of the Cruz/Texas argument - no need to bicker about fraud or the level of fraud - it is a strict argument that unconstitutional acts (acting outside of the express provisions of the state constitutions in those swing states) cannot be permitted to stand and ballots in violation of it have to be rejected.
