I mean, it could be sabre rattling too. I'm hoping Trump has the guts to do what is right. Trump loves this country so much, he will probably be devastated if he has to impose martial law. He will do everything in his power to avoid it.
Last I checked, the Constitution was the "Supreme Law of the Land", and I'm fairly certain that an honest interpretation of its statutes would support watering of the Tree over allowing commies to chop it down.
The only real "illegal" option Trump has, barring obviously ludicrous scenarios like mass murder (execution of traitors != murder) or other such standard CCP practices, would be to allow Biden and Harris into the White House.
Unless Trump just likes to randomly appoint loyalists to key positions and shorten the chain of command of the DoD (See https://www.whitehouse.gov/presidential-actions/executive-order-providing-order-succession-within-department-defense/) on a whim, then that is definitely his last resort (if all else fails tho).
