Is the argument that the VP, and any future VP, can simply not recognize electors based on their own judgement? I want to win and believe 100% the fix is in, but this argument doesn’t seem rational. Any future vp with a congressional college state majority could upend the election?
That’s not what the lawsuit was asking for. The lawsuit itself was completely stupid and makes no sense. You can’t file a lawsuit regarding what a VP should do against the acting VP, you have to confront Congress about this. The lawsuit was essentially seeking clarification of what the VP can do in accordance to the Constitution, which makes no sense. It’s like if you sued the President in regards to granting him the power to nominate a justice to the Supreme Court, you don’t need a court to clarify or authorize this, it’s already there.
Essentially, the problem here is that there is an ongoing debate of what Pence’s role is in counting the electoral votes. According to the ECA, if states have dueling electors (7 in this case), then the VP must count the EC votes of the electors which were certified by the governor. However, this is in complete contradiction with what the 12th Amendment states. Article 2 of the 12th Amendment clearly gives the state legislatures the power to seat electors and gives the VP “exclusive authority” over opening and counting the EC votes. If you simply go by the Constitution, the 12th Amendment overrules the ECA, thus making it the legal guideline that Pence can follow (ex. reading out Trump EC votes).
If Pence does indeed do anything outside of counting the Biden votes, then there will be a battle in the SCOTUS.
He can say that it's not his job to determine if there's fraud, and if the EC reaches his desk it's already passed the threshold
