You must have just read the headline. His DOJ lawyers wanted to dismiss the case because the lawsuit made no sense. Pence already has the power

In Gohmert's filing, he said that Pence told him last weekend that the VP doesn't have the power. That's why Gohmert sued Pence, to try to force Pence to change his mind.

That isn't how this works, if Pence is serious. Pence only needs to refuse to count them, then force a lawsuit over his decision. It will be too late to reverse it.

1887 EC Act is just a law and does not override the constitution and is unconstitutional. An amendment would have been needed which requires 3/4 states I believe. However, with the corruption in the Judiciary and lack or respect to the constitution nothing would surprise me anymore on their erroneous rulings.

Constitution is the supreme law of the land. Pence mag end up throwing those electoral votes out regardless and trump and pence going to scotus against the swamp. Constitutional law overrides federal law, especially when federal law goes directly against said constitution. Also, Pence could just play dumb and misinterpret the act because it makes no sense anyways.
