There's plenty of ways to circumvent the constitution.

Politicians pass an unconstitutional law. It takes a few years for someone to challenge it then have the process play out in the courts. If it gets declared unconstitutional they'll just pass a similar law with slightly different wording and wait for someone to challenge it again.

This is how leftist states keep unconstitutional gun bans in place.
