I believe that you mean - within the nuances of the interpretation of the 2nd and 12th Amendments and the ECA of 1887, it is the consensus opinion of the majority of legal scholars that Pence has merely a ceremonial role.
This has no bearing on what Pence can or should do. Pence can take a stand on principle and state that it is his opinion that these states selected their electors unconstitutionally and he will not open their envelopes.
At this point, it would go to SCOTUS. Would SCOTUS take it up? Would they fast track it? You don't know and neither do I. I doubt that they would. If Pence said - I am not opening any of these until we do a full forensic audit on these 6 states, why would SCOTUS intervene? There would be a 2 week time clock to resolve it.
So, you are objectively wrong. Nothing stops him from acting. Perhaps it would be short lived before SCOTUS intervenes, but I doubt it.
Yes he can do something. Even if the law is not on his side(I think it is), who gives a crap. Ignore it and do what's right. What he hell is the point of following the law when our enemies are going to ignore it at every juncture?
We have two options:
Burn the system turn and kill the communists.
Do nothing because it breaks traditions, and accept the destruction of western civilization.
Any approach that stops short of option 1, will result in option 2.
Leigh Dundas explains in her video that he CAN do something. The founding fathers set it up this way to avoid two groups having a stalemate and there is precedence for this.
It is my understanding some states have sent 2 sets of electors. What is your thoughts there, if Pence can't do anything? Does he read and count both, or neither?
Bull Shit! No Fraud then! No Foreign interference then! No system fraud (No algorithm switching votes) then! No mail in ballots with zero signature verification then! No Fake Mail in Ballots then!!!!
The danger of giving the VP the power to change the outcome of an election should be apparent. You know if an incumbent Dem administration could abuse it, they would, right?
he can, thomas jefferson did
thomas jefferson actually had balls

Explain.
His job is to count the votes given to him
He’s only been sent one slate by the state legislatures
He has no power to decide if they are legitimate
It is up to the states and they have 4 days if you include today and tomorrow
Oh awesome. Guess we’ll see Pence do what everyone is LARPing he’s going to do
Right
Found the liberal logic “attack the messenger, not the message”
As I understand it, don't constitutional scholars on both sides of the aisle disagree that his role is purely ceremonial.

here's an idea: if you want your state to be counted as valid, don't run a dirty election that puts 2 parties sending in electors
ie-get your damn house in order and you won't have these problems
Good argument.
