Joe Biden didn’t resign until 01/15/2009

Being that she just won re-election, the Ds need her vote for anything that goes on with the objections

What is so hard to understand about this?

"Yes, but she's vice-president elect and hasn't resigned her seat yet."

Again, Joe Biden was VP-elect for 4 months and resigned his senate seat 5 days before the inauguration.

This talking point about Harris not resigning is moot

it's not moot.

Not by a longshot.

https://definitions.uslegal.com/c/congressional-immunity/

  1. A Congress member is exempted from arrest while attending a session of the body to which the member belongs, excluding an arrest for treason, breach of the peace, or a felony, or;

2.A Congress member is exempted from arrest or interrogation for any speech or debate entered into during a legislative session.

In In re Grand Jury, 821 F.2d 946 (3d Cir. Pa. 1987), it was held that congressional immunity is an evidentiary privilege that is applied broadly to evidence or testimony about all acts that occur in the regular course of the legislative process. It therefore applies to activity taken in the course of legislative fact-finding.

She didn't just win re-election. She is not up until 2022.

The swearing in is a formality as it's a new Congress term.

That being said, agreed on everything else. No need for her to resign her seat. And her not doing so isn't an indication of anything.

She's also getting intel as a senator that the transition team would otherwise not have
