It's only a misdemeanor, he should just be processed given a court date and released max 2 hrs and he should be back on the street. If he's held any longer than that it should be unlawful imprisonment.

Misdemeanor's are not indightable offences, meaning you can't be jailed for them, shit I don't think you can even be detained for a misdemeanor.
